Roskomnadzor controls:
Documents containing personal data. The conditions of their storage are also controlled by this state body.
Data processing systems – PCs and programs.
Company website.
Availability of local regulations.
Facts of compliance with the provisions of regulatory acts.
The websites of companies have only recently begun to be checked. Collecting information about users without specifying how it will be used is a violation of citizens' rights.
There is no complete list of documents that Roskomnadzor is required to monitor. But in approximate form, this list looks like this:
constituent documents (TIN, charter, etc.);
notification to a government agency that the company uses personal data in its work;
list of information collected;
written consent of people to the processing of their personal data;
list of employees who have access to personal data;
a logbook of these employees;
an order to allow people to access information;
non-disclosure agreement;
instructions for working with data;
document on the processing of personal data;
provisions on liability for disclosure of information;
documents confirming that the information received by the company is properly protected;
safety instruction logs.
The inspection of a beauty salon may not be limited to these documents; Roskomnadzor has the right to request other documents as well.
The inspection lasts for 20 days. However, if serious grounds arise, this period may be doubled. For companies with no more than 100 employees, scheduled on-site inspections last a maximum of 50 hours. If the company has fewer than 15 employees, the inspection lasts 15 hours.
In order to successfully pass inspections, it is advisable to have an employee who understands the nuances of drawing up all the papers that are somehow related to the information direction. The volume of documentation here is quite significant, and an unprepared person simply will not cope.
But if large companies simply need such a specialist on staff, then small firms, such as beauty salons, may well involve outside experts before inspections.
In preparation for the inspection, you need to do the following:
Check if there is a notification about working with personal data. This document must be sent to Roskomnadzor before starting to work with the data.
Check whether the company's activities correspond to the information specified in the unified register.
Assign an employee responsible for working with personal data.
Draw up and record on paper the company's policy regarding data processing.
Prepare employees for an inspection of a beauty salon: write down rules of conduct, familiarize them with all necessary documents.
Check whether the documentation storage procedure complies with established standards and whether access to papers is restricted.
Assess the security system: check for locks and safes.
All necessary documents can be prepared using special online services.
If errors or shortcomings are found in the documents provided, an on-site inspection is scheduled, conducted by at least two inspectors. Upon arrival at the company, they are required to present identification and a copy of the order that is the basis for such an event.
After the inspection, a report is drawn up. If errors were found as a result of the inspection, they are recorded in the document. The person representing the organization being inspected personally gets acquainted with the report. Or the document can be sent to the responsible person of the company by registered mail. The results of the inspection are posted on the Roskomnadzor website.
Within 15 days, the inspection results can be appealed by sending specific and substantiated objections to the department.
The entrepreneur has the right to refer to the fact that he did not receive the notification of the inspection within the required time, that the inspection was carried out by specialists without accreditation, that the deadlines for conducting the inspection were violated - if, of course, these facts actually took place.
