The nuances of concluding and terminating an employment contract with the company president
The procedure for concluding an employment contract with the president has a number of differences from the usual procedure for signing contracts with employees due to greater responsibility and the presence of specific job functions. The Labor Code of the Russian Federation defines the specifics of legal regulation of the labor of managers of this rank. All relations between the president and the company are within the legal field regulated by the set of federal laws of the Russian Federation, regional and local regulatory legal acts, including the Company Charter, if their provisions do not contradict state instructions.

The main difference from regular employment is the mandatory recording of the legal entity in the employer’s contract with the company’s president.

The employment contract specifies:

the employee’s last name, first name, patronymic, name of the employer and information about identity documents;

labor function;

payment provisions;

working conditions in the workplace.

The President does not have the right to perform other regular paid work under an employment contract in his free time. Part-time work is possible for him only with the employer's approval.

In accordance with Article 277 of the Labor Code of the Russian Federation, the head of an organization bears full financial liability for direct actual damage caused to the company in the process of fulfilling his duties specified in the contract.
